According to Montana law, it is unlawful for anyone to drive while having a BAC (blood alcohol content) of 0.08% or higher. Drivers under the age of 21 are prohibited to drive with a BAC of 0.02% or higher. Possible penalties faced by a person convicted of driving under the influence include fines, mandatory attendance in drug and alcohol abuse education programs, suspension of one's driver's license, as well as possible prison terms depending on aggravating circumstances. An ignition interlock device may also be ordered by the court to be installed in the motorist's car. An ignition interlock device is a device that measures the alcohol content of a person's breath and prevents him or her from starting the vehicle if traces of alcohol are detected. Severe penalties are also meted when the person is found to have a blood alcohol level of 0.16% or higher. This case is referred to as an aggravated DUI.
